Terms of Service

Backhouse is a cloud-based software-as-a-service (SaaS) platform designed for the hospitality industry, operated by DDTIM Advisors LLC DBA Backhouse. Our platform provides restaurant and venue operators with tools for staff scheduling, tip management, inventory tracking, daily sales reporting, communication, and operational workflow management.

The Service is provided on a subscription basis and is accessible via web browsers and mobile devices. Features and functionality may vary depending on your subscription tier and venue configuration.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make commercially reasonable efforts to notify active subscribers of material changes at least 30 days in advance.

To access the Service, you must create an account and provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account administrators (managers) are responsible for managing user access within their venue, including adding, removing, and assigning roles to team members. Each user must have a unique account; sharing of login credentials is prohibited.

You must be at least 18 years old to create a manager account. Staff accounts may be created for individuals 16 years and older, in compliance with applicable labor laws in your jurisdiction.

You agree to notify us immediately of any unauthorized access to or use of your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to store, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to gain unauthorized access to other accounts, the Service infrastructure, or any systems or networks connected to the Service.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service in any manner that could damage, disable, overburden, or impair our servers or interfere with any other party's use of the Service.
• Resell, sublicense, or otherwise commercialize the Service without prior written consent from DDTIM Advisors LLC DBA Backhouse.

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all data you input into the Service ("Customer Data"). We will not access, use, or share your Customer Data except as necessary to provide the Service, comply with the law, or as otherwise described in our Privacy Policy.

We implement industry-standard security measures to protect your data, including encryption in transit and at rest, regular security audits, and access controls. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Upon termination of your account, you may request an export of your Customer Data within 30 days. After this period, we may delete your data in accordance with our data retention policies.

To the maximum extent permitted by applicable law, DDTIM Advisors LLC DBA Backhouse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Service during the twelve (12) months preceding the event giving rise to the claim.

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You may terminate your account at any time by contacting our support team or through the account settings in the Service. Termination will take effect at the end of your current billing period unless otherwise agreed.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach any provision of these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a security risk.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
